Short title, extent and commencement

1.

1. This act may be called the Gujarat Electricity Industry (Reorganisation and Regulation) act, 2003.
2. It extends to the whole of the State of Gujarat.

3. It shall come into force on such date as the State Government may, by notification in the Official Gazette, appoint.

Definitions

2. In this Act, unless the context otherwise requires:-

1. "Advisory committee" means a committee constituted under section 41;

2. "Central Act" means the electricity Regulatory commissions Act, 1998;

3. "Central Commission" means the Central Electricity Regulatory Commission established under sub-section (1) of section 3 of the Central act;

4. "Chairperson" means the Chairperson of the Commission;

5. "Commission" means the Gujarat Electricity Regulatory Commission established or deemed to be established under section 3;

6. "Electricity Industry" means business or activities of generation, transmission, distribution or supply of electricity, the operation of power system and activities and matters connected thereto;

7. "High Court" means the High Court of Gujarat;

8. "Licence" means a licence granted under section 20 or deemed to be granted under section 19;

9. "Licensee" means a person holding a licence;

10. "Local authority" means a municipal corporation, nagar panchayat , municipal council, district panchayat, taluka panchayat, notified area committee or Cantonment Board constituted under the relevant local authority law;

11. "Member" means a member of the Commission and includes the Chairperson;

12. "Prescribed" means prescribed by rules;

13. "regulations" means regulation made under this act;

14. "relevant local authority law"

1. In relation to a city, the Bombay Provincial Municipal Corporations Act, 1949;

Guj. 34 of 1964.

2. In relation to a municipal borough, transitional area, smaller urban area and notified area, the Gujarat Municipalities act, 1963;

Guj. 18 of 1993.

3. In relation to a taluka and district, the Gujarat Panchayats Act 1993;

4. In relation to a cantonment, the Cantonments Act, 1924;

15. "Rules" means rules made under this Act;

16. "Selection Committee" means the Selection Committee constituted under section 6;

17. "Undertaking" means an unit engaged in generation transmission, distribution or supply of electricity or in any other activity connected with the operation of Power system in the State;

18. Words and expressions used but not defined in this Act and defined in the Central Act shall have the meanings respectively assigned to them in that act;

19. Words and expressions used but not defined either in this act or in the Central Act and defined in the Indian Electricity Act, 1910, or in the Electricity (Supply) Act, 1948 shall have the meanings respectively assigned to them in those Acts.
