APPLICATION FOR GRANT OF MINING LEASE

APPLICATION FOR GRANT OF EXPLORATION LICENCE
1. PETROLEUM EXPLORATION LICENCE (PEL).
In order to carry out the exploration and
exploitation of the oil and gas resources the applicant has to apply
to the state government for PEL. The PEL is applied to the state
government along with the following documents:

Application in the prescribed format. The
application should be in five copies.

Map showing the area applied for PEL along
with the latitudes and longitudes of the corner points. The
scale of the map should be 1: 50,000.

The names of the villages along with the
survey numbers falling in the area applied should be submitted.

Application fees of Rs.25, 000/- along with
the first year license fees @ Rs.50/- per Sq.Km. Should be paid
in advance.

Security deposit amounting to Rs1,00,000/- be
deposited.
All the payment should be made through challan.
After processing the application the Directorate
of Petroleum issues technical NOC and the Collector issues general
NOC. After obtaining prior approval from the Government of India and
receiving both the NOC’s the licensing authority i.e. Energy and
Petrochemicals Department issues the PEL grant order under rule 5(1)
of PNG Rules-1959. Initially a license is issued for four years and
a renewal of one year each (i.e max. of 2 years) is granted.
As per the provisions of rule-11 (2) of PNG
Rules-1959 the license fees structure is as follows.
First year license fees
Rs.50/- per sq. km.
Second year license fees
Rs.100/- per sq. km.
Third year license fees
Rs.500/- per sq. km.
Fourth year license fees
Rs.700/- per sq. km.
First year renewal of the license. Rs.1000/- per sq. km.
Subsequent renewal of license. Rs.1000/- per sq. km.
After the license is issued the licensee has to
execute the license deed with the concerned District Collector.
The licensee can relinquish either a part or
entire area of the PEL by applying for the relinquishment along with
the map showing the entire and the shaded area to be relinquished.
The application of relinquishment should be made two months before
relinquishment. Upon relinquishment the licensee has to submit the
detailed geological report along with the data acquired. The order
for relinquishment is issued to the licensee.
If the PEL area is prospective then the area can
be applied for the grant of the Mining Lease (ML) to the state
government. The List of PEL fields in Gujarat State is enclosed
2. PETROLEUM MINING LEASE (PML)
The application of the mining lease should be
made in the standard format along with the following documents.
1. Application in the prescribed format. The
application should be three copies.
2. Map showing the area under PEL converted ML along with the
latitudes and longitudes of the corner points. The scale of the map
should be 1: 50,000.
3. The names of the villages along with the survey numbers falling
in the area applied should be submitted.
4. For meeting preliminary expenses an amount of Rs.30, 000/- to be
deposited.
5. Application fees amounting to Rs.50, 000/- to be deposited.
6. Security deposit amounting to Rs.2,00,000/- to be deposited.
All the payment should be made through challan.
As per the provisions of Rule 5 (1) of PNG Rules-1959 the State
Government issues Mining Lease for 20 years
The lessee shall pay the royalty on the oil, gas and condensate
produced from the field at the rates prescribed by the Government of
India from time to time.
The surface rent is to be paid at the rate of Rs.10, 000/- per sq.km
for the area actually used by the lessee.
If the field is not producing then the lessee has to pay the dead
rent at the rate of Rs.25 /- per hectare or a part thereof for the
first 100 sq.km and Rs.50 per hectare or part thereof for area
exceeding first 100 sq.km.
